This Privacy Policy explains how Urban Edge Properties, its subsidiaries, and its affiliates (collectively, “Urban Edge”, “we”, “our”, or “us”) collects, how we use and share information about you, with whom we share it, and your choices in connection with this. This Privacy Policy applies to our marketing website (https://uedge.com/), investor website (https://investors.uedge.com/), your interaction with our properties, and any other digital platform that displays this Privacy Policy (collectively, the “Services”). This Privacy Policy will explain:

  • The Personal Information we collect.
  • How we use your Personal Information.
  • With whom we share your Personal Information.
  • Your rights with respect to your Personal Information.
  • How to contact us with any questions or concerns.

1. HOW AND WHEN WE COLLECT PERSONAL INFORMATION

Personal information is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, to you (“Personal Information”). We will retain your information for as long as it is necessary for the purpose of the processing, unless we receive a request to delete this information and no exception to your right to deletion applies. When you interact with the Services, we collect your Personal Information. This includes when you:

Contact us. When you communicate with us or send any questions, comments, feedback, or suggestions, you will need to provide us with your personal identifiers (name, email address and/or telephone number). We use this Personal Information to respond to your questions or inquires, troubleshoot where necessary, and address any issues you have with the Services.

Join our loyalty program. If you join our loyalty program to access savings and other perks, please visit our Loyalty Program Privacy Policy.

Participate in social media. If you interact with our social media pages, we may collect Personal Information you choose to disclose including personal identifiers (name, social media handle, and email address) and visual information (your social media photo or your photograph). When you interact with our fan page on social networking websites (each a “Fan Page” and collectively “Fan Pages”), such as Facebook, LinkedIn, and Instagram (the “Social Networks”), we collect basic engagement metrics and use it to tailor content and marketing and use it to improve user experience as set forth in this section. Please note that we do not control the use or storage of the information that you have posted to any social networking websites. This information is collected and processed by the social networking websites for their own purposes, including marketing.   • Fan Pages. When interacting with our Fan Pages, we collect, from you, your personal identifiers (first and last name) and visual information (photograph (i.e., profile picture)), as well as any information that you provide when interacting with our Fan Pages (e.g., commenting, sharing, and rating). We use this information to advertise our products, for events and invitations, and to communicate with users via the contribution and comment function. Because our Fan Pages are publicly accessible, when you use them to interact with other users, for example by posting, leaving comments or liking or sharing posts, any Personal Information that you post in them or provide when registering can be viewed by others or used by them as they see fit. The content posted on our Fan Pages or other public areas of social networking websites can be deleted in the same way as other content that you have created. If at any time you want content posted to be deleted, please email your request to us at privacy@uedge.com.
  • Community Management. We collect, from you, your contact, including "likes", shares, messages and other interactions with the content, in order to analyze and evaluate how our content is perceived, to learn from it, and to improve our public relations efforts. We use this information to create advertisements that match our Fan Page and to disseminate them via the Social Network based on demographic data.
  • Surveys. When you participate in a survey on our Fan Pages, we collect, from you, your personal identifiers (email address), your internet or other electronic network activity information (device and browser data, IP address, location information based on the IP address), log data (IP address to determine whether a respondent has previously participated in a survey), and metadata (usage patterns)). We use this information to analyze and process the results of our surveys for market research purposes.
  • Contests or Sweepstakes. When you participate in a contest or sweepstakes on our Fan Pages, we collect, from you, your personal identifiers (name, email address, telephone number, and physical address (if provided)), and your visual identifiers (photograph (i.e., profile picture)). We use this information to manage your entry, communicate with you about your entry, and to run the sweepstakes or contest. We also use this information to create unique offers to enhance your customer experience. If it is necessary to send non-cash prizes, we will forward your information to a shipping service provider.
  • Events and Photos. When you register for an event on our Fan Pages, we collect, from you, your personal identifiers (first and name, email address, telephone number, physical address, and any other information you provide). We use this information to create and manage the event (e.g., to create the guest list, accreditation and admission control, room and personnel planning, planning the catering) as well as to send you your invitation and notifications about the event. We also use this information for prevention of fraud and defense against legal claims. At events for which you have registered, photos and video recordings may be made (possibly by a photographer commissioned by us), in which you may also be shown. If you are the central subject of a recording, the photographer will ask you before the recording/taking the photo whether you agree and consent. We use the photos for our public relations and marketing on our various media/digital media outlets.
  • Messenger Functionality. When using messenger functionality on Social Networks, Social Networds collect, automatically, your internet or other electronic network activity information (IP address, date and time of the server request, time zone, specific browser or app function, access status, amount of data transferred, browser or app from which the Request comes, device type, operating system used, and its interface (e.g., Android or IOS), language, version of the operating system, and device identifiers). We do not use this information; its use is governed by the respective Social Networks’ privacy policies (linked above).
  • Page Insights. When you visit our Social Network Page, the Social Network records your IP address and other information about your usage behavior on our Social Network Fan Page. The Social Network collects, through trackers in the browser of your device or via the advertising ID (IDFA from Apple or GAID from Google), when you open the Social Network app through your mobile device (e.g., smartphone or tablet). Social Network uses this information to provide us with statistical evaluations of the use of our Social Network Fan Page. We receive this information directly from Social Network, in the form of aggregated data and anonymous statistics regarding certain data points, such as: age; gender; city/country; device; inquiries from fans about other Social Network fan pages; region and language settings of the users; proportion of men and women; the number of people reached; clicks on posts, "Likes” and reactions; comments and shared content; and total video views. We use this information to analyze and improve the advertising campaigns we conduct through our Social Network Fan Page. We do not collect or process any other Personal Information in connection with Social Network “Page Insights” function. We do not retain this information independently. For information on data protection and the storage period on the Social Network in relation to its Insights function, see the Social Network privacy policy linked above. It has been contractually agreed with the Social Network that the Social Network is responsible for providing you with information about the processing for Page Insights.
  • Information Processed Solely by Social Networks. We do not know how the Social Networks use Personal Information for its own purposes, how long the Personal Information is stored on the Social Network or whether the Social Network data is passed on to third parties. If you are currently logged in to a Social Network as a user, the Social Network automatically collects, through trackers on your device, your Social Network ID or a link between the Social Network ID and the advertising ID (IDFA from Apple or GAID from Google) when you open the Social Network app through your mobile device (e.g., smartphone or tablet). This enables the Social Network to understand that you have visited our Social Network Fan Page along with other Social network pages that you have clicked on, whether you clicked on Social Network buttons integrated into websites that partner with the Social Network, and other online interactions that report user data to the Social Network. Based on this data, content or advertising tailored to you can be offered. You can find more information about the Personal Information collected by Social Networks, how it is used and how long it is stored by visiting the Social Network’s privacy policies, linked above.

Register for an event. If you register for an event, you will be required to provide us with your personal identifiers (name, email address, and physical address). You may also be prompted to provide us with commercial information (details on spending, frequency of visits, or favorite stores). We use this Personal Information to manage your event registration.

Sign up for offers and promotions. You have the option to elect to receive offers on products and services we feel may be of interest to you. To sign up for these offers, you will provide personal identifiers (name and email address or telephone number). We use this Personal Information to send you the offers and promotions you requested. We may also use this Personal Information to send you marketing communications we feel may be of interest to you.

Visit our properties. When you visit our properties, we may capture visual information of you (CCTV footage). We use this Personal Information to monitor the safety of our properties and visitors. For our New Jersey and Puerto Rico properties, our CCTV includes facial recognition features that measures your facial geometry to distinguish between the face of a human and the face of an animal or objects. We use this facial recognition software to help with the security and safety of our property and our visitors, and count foot traffic. This information will be shared with our CCTV technology service provider. Also, this information is shared with law enforcement.

Park in our parking garage. When you park in an Urban Edge-owned parking garage, we use “Park Assist” which takes a picture of your vehicles license plate and vehicle in its parked location and when you enter the parking garage. We use this information to assist you with relocating your parking spot, calculating the parking fee, and for the security of our property and visitors. This information is shared with county and state law enforcement.

Utilize our complimentary Wi-Fi. If you utilize our complimentary Wi-Fi, we will collect personal identifiers (email address) and your internet and other electronic network activity information, (device ID). We use this Personal Information to provide the complimentary Wi-Fi. Your internet and other electronic network activity information will be shared with our Wi-Fi provider to provide the complimentary Wi-Fi.

Utilize the tenant engagement application. When you utilize the tenant engagement application, we will collect, through our tenant engagement application, your identifiers (name, email address, telephone, password), internet and other electronic network activity information (type of device, what operating system is used, device settings, application IDs, unique device identifiers and crash data). We use this information to engage with and provide information to our tenants, including sending you marketing communications (See “Subscribe to our marketing communications” section below). Your identifiers and internet and other electronic network activity information are shared with our application provider to provide the application. Subscribe to our marketing communications. When you sign up for the VIP program, you are automatically signed up to receive marketing communications from us. We will collect your identifiers (name and e-mail address) to send you e-mail marketing communications. You can opt-out of future email communications by clicking the “Unsubscribe” button at the bottom of each email. We may share your identifiers and contact information with our third party marketing providers who send you marketing emails on our behalf. Please note that we will continue to send you notifications related to notifications that are necessary to the Services, or notifications regarding requested services. If you opt-in to your emails being tracked, our e-mail communications will analyze whether a predefined action took place by a recipient, such as opening our communications or clicking on a specific item, in order to better adapt and distribute our communications.

Aggregate data. We aggregate the data we collect for benchmarking purposes and for internal analytics.

Automatic Data Collection. We collect information automatically through cookies and similar technologies as you use our Services to: (i) track you within the Services; (ii) enhance user experience; (iii) conduct analytics to improve the Services; (iv) prevent fraudulent use of the Services; (v) diagnosis and repair Services errors, and, in cases of abuse, track and mitigate the abuse. This includes the following internet or other electronic network activity information:

  • Usage information. We use essential, performance, and analytics cookies to collect information about your interaction with our Services, such as what you access, what you click on, the frequency of access, and how much time you spend on the Services.
  • Device information. We use essential, performance, and analytics cookies to collect certain information about the device you use to access the Services, such as browser type, browser language, hardware model, operating system, and device preferences.
  • Location information. We use essential, performance, and analytics cookies to collect information about your location, which may be determined through your IP address.

Particular third-party cookies to note on our Website include:

  • Google Analytics. We use Google Analytics to collect information on your use of our website and use this information to improve our website and our Services. In order to collect this information, Google Analytics may set cookies on your device or read cookies that are already there. Google Analytics may also receive information about you from apps you have downloaded that partner with Google. Google’s ability to use and share information collected by Google Analytics about your visits to our website or to another application which partners with Google is restricted by the Google Analytics Terms of Use and the Google Privacy Policy, available here. You can control the information provided to Google by using any of the methods set forth here or using the Google Analytics opt out browser add-on here.   • YouTube. We use YouTube (owned by Google) as our video platform to embed content from YouTube on our website. YouTube uses these cookies to track viewing statistics and assign a unique identifier to the device on which the video is viewed, enabling YouTube to recognize the device. This data is collected by Google. Google can use this data to show relevant advertising and for its own promotional purposes in accordance with Google’s Privacy Policy. The Google cookies also allow YouTube and its partners to show you advertisements on and outside of YouTube. To opt-out of this sharing and displaying of YouTube ads, visit Your data in YouTube, where you can clear and control the information YouTube collects on you. Urban Edge may also use the Personal Information we collect as described in this section to comply with the law, to efficiently maintain our business, and for other limited circumstances as described in HOW WE SHARE YOUR PERSONAL INFORMATION.

2. DATA RETENTION

We may need to use and retain your Personal Information for longer than the periods indicated above for purposes of:

  • Compliance with our legal obligations. For example, retaining your records for the purpose of accounting, dispute resolution, and compliance with labor, tax, and financial regulations.
  • Meeting our safety and security commitments. Such as keeping our properties secure and preventing fraud.
  • Exercising or defending legal claims. We also may need to retain information for longer than the terms in order to meet with legal process or enforceable governmental request.

3. HOW WE SHARE YOUR PERSONAL INFORMATION

We may share your Personal Information in the following circumstances:

Sharing Generally

Within Urban Edge. We may share your Personal Information within Urban Edge, which includes Urban Edge affiliates and subsidiaries for the legitimate business purposes of efficiently and effectively providing the Services, such as accounting and customer service support. Access to your Personal Information is limited to those on a need-to-know basis.

With service providers. We may share the Personal Information we collect with third parties who perform services on our behalf, to provide the Services. These service providers are described more specifically in the WHEN AND HOW WE COLLECT PERSONAL INFORMATION section. However, generally, these service providers include our analytics provider, web hosting providers, email marketing provider, CCTV provider, tenant engagement application (if applicable), customer service providers, professional consultants, and creative agencies.

In the event of a corporate reorganization. In the event that we enter into or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share Personal Information with third parties, including the buyer or target for the purpose of facilitating and completing the transaction. We would also share Personal Information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.

To prevent harm. We will share Personal Information if we believe it is necessary to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person.

For legal purposes. We will share your Personal Information where we are legally required to do so, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of service or other contracts; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law.

With your consent. Apart from the reasons identified above, we may request your permission to share your Personal Information for a specific purpose. We will notify you and request consent before you provide the Personal Information or before the Personal Information you have already provided is shared for such purpose. You may revoke your consent at any time.

Sharing In The Preceding Twelve (12) Months

For a business purposes. In the preceding twelve (12) months, Urban Edge has disclosed the following categories of Personal Information for a business with the following categories of third parties:

  • We have disclosed your internet or other electronic network activity to our IT support and website providers to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and to identify and repair website and mobile application errors that impair functionality.
  • We have disclosed your internet or other electronic network information to our IT support and website providers to maintain, improve, and upgrade the website.
  • We have disclosed your personal identifiers, internet or other electronic network activity information, and commercial information to service providers that perform services on our behalf. These service providers include our data analytics provider, website providers, customer service provider, professional consultants, and creative agencies.
  • We have disclosed your visual information (recording of your physical appearance) to our CCTV provider to protect our tentant’s customer, our customer’s property, and our property.

For a sale/sharing. Under the California Privacy Rights Act, our use of cookies for analytics and disclosure of your information to our loyalty program management provider constitutes a sale. In the preceding twelve (12) months, we have disclosed your internet or other electronic network activity information to third parties who assist us in data analytics on our Services, and we have disclosed your identifiers with our loyalty management provider to administer our loyalty program. These disclosures are considered a “sale” or “sharing” under the California Privacy Rights Act. You may opt-out of this sharing by visiting Do Not Sell or Share My Personal Information.

4. INFORMATION SECURITY

No method of transmission over the Internet is fully secure. While we have implemented reasonable measures to protect your Personal Information from unauthorized access, use, alteration, or disclosure, we cannot guarantee the absolute security of your Personal Information. Any transmission of Personal Information is at your own risk.

5. YOUR INFORMATION CHOICES

Correct or view your information. You may access your account to correct or view certain Personal Information you have provided to us and which is associated with your account.

Device location settings. You may prevent your mobile device from sharing your location data by adjusting the permissions on your mobile device.

Google Analytics. You can control the information provided to Google by using any of the methods set forth here or using the Google Analytics opt out browser add-on here.

Cookies. All session cookies are temporary and expire after you close your web browser. Persistent cookies can be removed by following your web browser’s directions. Please note that each web browser is different. To find information relating to your browser, visit the browser developer’s Website and mobile application. If you reset your web browser to refuse all cookies or to indicate when a cookie is being sent, some features of our website may not function properly. If you choose to opt out, we will place an "opt-out cookie" on your device. The "opt-out cookie" is browser specific and device specific and only lasts until cookies are cleared from your browser or device. The opt-out cookie will not work for essential cookies. If the cookie is removed or deleted, if you upgrade your browser or if you visit us from a different computer, you will need to return and update your preferences. By clicking on the “Opt-Out” links below, you will be directed to the respective third-party website where your computer will be scanned to determine who maintains cookies on you. At that time, you can either choose to opt out of all targeted advertising or you can choose to opt out of targeted advertising by selecting individual companies who maintain a cookie on your machine.

Promotional Emails. You may opt-out of receiving promotional emails from us by clicking the “unsubscribe” link provided with each email. Please note that we will continue to send you Services-related communications or to deliver notifications about the website.

Text Messages. We may send you text messages you have consented to receive. You can cancel text messages at any time by texting “STOP.” After you opt-out we may send you additional text messages to confirm you have unsubscribed.

6. DO NOT TRACK

We do not support Do Not Track (DNT). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked. 7. RIGHTS OF CONSUMERS

A. Rights of California Residents

The California Privacy Rights Act (“CPRA”) entitles residents of California to certain rights. To the extent the CPRA applies to our processing of your Personal Information, you are entitled to the following rights:

  • Right to Access/Know. You have the right to request what Personal Information we have collected, used, disclosed, and sold about you, unless an exception applies. You may only make a request for access twice within a 12-month period.
  • Right to Deletion. You have the right to request the deletion of your Personal Information that we collect or maintain, subject to certain exceptions. For example, if we are required by law to retain the information that you are asking be deleted, we would not be able to delete the information until we are legally permitted to delete it.
  • Right to Opt Out of Sale/Sharing. You have the right to opt out of the sale or sharing of your Personal Information to third parties. Urban Edge does not have actual knowledge that it sells or shares Personal Information of minors under the age of sixteen (16) years without their affirmative consent.
  • Right to Non-Discrimination. You have the right to not receive discriminatory treatment if and when you exercise your rights to access, delete, opt out, correct, or limit use of sensitive Personal Information.
  • Right to Correct. You have the right to correct inaccurate personal information that we collect or maintain.

B. Exercising your rights

To exercise your rights, as applicable, you may submit a request by contacting us by email at privacy@uedge.com or our toll-free number 833-975-1446, or through our online webform. To opt out of the sale or sharing of your Personal Information via cookies, please visit Do Not Sell or Share My Personal Information or utilize the opt out preference signal to instruct us to not sell or share any of your Personal Information collected online. The opt out preference signal will apply to the device, platform, or browser in which you utilize it. You can utilize the opt out preference signal by turning on the signal in your device, platform, or browser settings.

For requests submitted via email, you must provide us with sufficient information that allows us to reasonably verify you are the person about whom we collected the Personal Information (specifically, your name, address, email address, and telephone number) and describe your request with sufficient detail to allow us to properly evaluate and respond to it. In doing so, we will take steps to verify your request by matching information provided by you with the information we have in our records. If we are not able to verify your identity for access and deletion requests with the information provided, we may ask you for additional pieces of information.

Only you, or a person that you authorize to act on your behalf may make a request related to your Personal Information. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation that you are authorized to act on behalf of that individual.

C. Nevada Residents

If you are a consumer in the State of Nevada, you may request to opt-out of the current or future sale of your Personal Information. You can submit a request to opt-out of future sales by contacting us at privacy@uedge.com. Please include “Opt-Out Request Under Nevada Law” in the subject line of your message.

8. CHILDREN

Our Services are not intended for children under the age of eighteen (18) years. Accordingly, we do not knowingly collect or share Personal Information from children.

9. CHANGES TO THIS PRIVACY POLICY

This Privacy Policy is subject to change at the sole discretion of Urban Edge. Changes to the Privacy Policy will be posted on this page and will indicate the date the changes go into effect. Please check back frequently and review the Privacy Policy for any changes. If we make any changes that materially affect your privacy rights, we will announce those changes via prominent posting on our Website.
